GENERAL SHIPPING AND TRADE CONDITIONS

1.General

The following shipping and trade conditions in their own equal terms apply to all trade affiliations of any kind between VIBRASS Lederer Capital Company and the customer.
Aberrations to these conditions are only valid when the contract partners have explicitly agreed to them, in written form.
Any order that has been placed by a customer, no matter if by telephone, Fax, Internet, e-mail or any other form, constitute the offer for completion of a contract of purchase. This type of order becomes a binding contract of purchase only when VIBRASS confirms it in written form, when the item is being shipped out and/or when the invoice is issued.

VIBRASS retains the right to break the contract if, by no fault of VIBRASS, VIBRASS is unable to provide the service. In this case the customer will be contacted immediately. Any fulfilled merits from sides of the customer will immediately be reimbursed. Any further demands the customer might have of VIBRASS are barred.

2.Conclusion of agreement/contract

The contract has been completed as soon as VIBRASS receives the order and sends out its order confirmation. Subsequent changes or supplements are only valid when agreed to in written form.

3. Shipping and shipping costs

3.1 Shipping in Austria

The customer’s order is shipped out at the lowest cost options for shipping. The all-inclusive shipping price for requested items in Austria is 0,00 EUR. However the customer can basically opt for other shipping (Express, UPS, DHL and others) if VIBRASS has access to these respectable services. The additional costs have to be balanced by the customer.

Any eventual damage during shipping is not covered by VIBRASS.

3.2 Shipping in the European Union

The customer’s order is shipped out at the lowest cost options for shipping. The all-inclusive shipping price for the EU is 3,00 EUR. The customer can opt for other shipping.
Any eventual damage during shipping is not covered by VIBRASS.

3.3 International shipping

Naturally we can ship to customers all over the world. The all-inclusive global shipping price is 5,00 EUR. The customer can opt for other shipping.
The customer must carry any eventual payments to customs, customs taxes, as well as the import taxes. VIBRASS has neither influence over nor Information on the valid customs and taxes at the time of purchase.
Any eventual damage during shipping is not covered by VIBRASS.

4. Prices

All prices are in EURO, including the legal VAT/sales tax of 20 %, and the additional shipping costs,  plus eventual pay on delivery charges. The shopping prices for distributors/resellers include VAT. The valid VAT is regulated by the Austrian tax authority. Shippings outside of the EU do not include VAT.

Upon receipt, the wares should be carefully checked for any damages that occurred during shipping, either by the customer or authorized person. Damages should be reported immediately in written form. Any eventual damage on the shipping packages should be confirmed upon receipt, in written form, by the carrying business.

VIBRASS ensures delivery in three days, one day after the date the order has been received, unless, by no fault of VIBRASS, the service provision is not possible.

5. Payment

The order payment normally occurs via pay on delivery (only in Austria and Germany), prepayment, credit card (VISA, Mastercard, American Express) or PayPal. VIBRASS keeps the right to deny certain payment options. Paying in cash or by check sent by mail is not possible. VIBRASS cannot guarantee safe handling of money or checks sent by mail. Subtracting trade discount is not possible. Payments with credit card are charged as soon as the ware is shipped out. When paying on delivery, there is an additional charge of 4,20 EUR in Austria.

The shipped wares belong to VIBRASS until the payment is completed. In the case of resale the customer is obliged to transfer their claims from the resale to secure the purchase price to VIBRASS and register these in their accounting books.

6. Guarantee

VIBRASS guarantees its products are free of defects basically for two years.

The services VIBRASS guarantees by its own choice are item repairs, exchange of broken parts or substitution. Pieces exchanged in repairs become property of VIBRASS. Repaired items do not receive a prolonged guarantee.

The customer is obliged to examine his product without delay,  guarantee services can only be entitled to clients who immediately report any defects, in written form. Oral reclamations by telephone will not suffice. VIBRASS applies guarantee only to defects that occur in compliance with the intended operation conditions. These certainly do not concern defects that have been caused by customers or third parties attempting to repair or alter the product without VIBRASS’ written consent.

Not included in the guarantee service are damages that pertain to natural abrasion, improper usage and deficient or wrong maintenance. Any further liability, particularly in connection with any consequential damages or damages of any kind, beyond the value of the supplied part, are excluded.

7. Delivery conditions

There is no entitlement to delivery if we are not able to procure a product.

8. Jurisdiction and Law

All disputes arising directly or indirectly from this contract will be settled upon in the appropriate jurisdiction court in Klagenfurt.

All contractual relationships are subject to Austrian law – with the exception of the United Nations Convention on International Sale of Goods (UNICITRAL) – Application.

9. Final clause

If any of these provisions – for whatever reason – no longer applies, the validity of the remaining provisions shall not be affected.
